TERMS AND CONDITIONS

Please Read Carefully

  1. Definition of Parties. In this contract the terms "we" and "Prana" refer to Prana Yoga Teacher College Inc., doing business as Prana Yoga Teacher College; and the terms "you", "student" and "applicant" refer to that person whose signature appears on page one of the contract.

  2. Admission Requirements. Applicants must be in good health and fit to undertake training.

  3. Cancellation of Course. In the event of insufficient enrolment, we may, at any time prior to the start of the Teacher Training Program, be required to cancel the program, in which case any course fees paid will be refunded (unfortunately we are unable to provide any further compensation).

  4. Rejection or Cancellation of Registration. Due to the intimate and intense nature of the Program, we reserve the right to decline or cancel any registration at any time prior to the start of the Program, in which case any program fees paid will be refunded (unfortunately we are unable to provide any further compensation).

  5. Dismissal During Course. To ensure as much as possible the enjoyment of all students (and their teacher!), inappropriate behavior by a student during the Program (as determined by the course instructor, acting reasonably) will not be tolerated and may result in the student being given written notice and having to leave immediately, and the student's registration cancelled, subject to paragraph 7 below, without any refund or compensation. Inappropriate behavior includes absenteeism for longer than two consecutive days of classes without informing a Prana representative and providing a reasonable explanation, cheating or plagiarism, theft or non-accidental damage to Prana's property. Behavior displaying insubordination, refusal to co-operate with instructors, fellow students or schedules, use of alcohol or non-prescription drugs in class or attending classes under the influence of alcohol or non-prescription drugs, flagrant disrespect of Prana's rules of conduct and policies, and non-payment of scheduled tuition fee payments, if applicable.

  6. Refund Policy - Before Start of Course. For financial details see page 1. A student must provide written notice to Prana if he or she wishes to withdraw from the Program. Where total fees have not yet been collected, Prana is not responsible for refunding more than has been collected to date.
    1. If Prana receives such written notice less than seven (7) calendar days after this contract is made and before the Program starts, Prana may retain the lesser of 10% of the total fees due under this contract or $100, or, in the case of international students, the lesser of 25% of the total fees due under this contract or $400.
    2. Subject to paragraph 6(a) above, if Prana receives such written notice after this contract is made and thirty (30) calendar days or more before the Program starts, Prana may retain 10% of the total fees due under this contract, or, in the case of international students, 25% of the total fees due under this contract.
    3. Subject to paragraph 6(a) above, if Prana receives such written notice after this contract is made and less than thirty (30) calendar days before the Program starts, Prana may retain 20% of the total fees due under this contract, or, in the case of international students, 40% of the total fees due under this contract.

  7. Refund Policy - After Start of Course. Where total fees have not yet been collected, Prana is not responsible for refunding more than has been collected to date.
    1. If Prana receives written notice of withdrawal, or a student is dismissed, within 10% of the Program duration Prana may retain 30% of the total fees due under this contract, or, in the case of international students, 50% of the total fees due under this contract.
    2. Subject to paragraph 7(a) above, if Prana receives written notice of withdrawal, or a student is dismissed, within 30% of the Program duration, Prana may retain 50% of the fees due under this contract, or, in the case of international students, 70% of the total fees due under this contract.
    3. If a student withdraws or is dismissed after 30% of the Program duration, no refund is required.

  8. International Students. For the purposes of paragraphs 6 and 7, an international student is a person who is not a Canadian citizen, who is not a landed immigrant and who has not been determined under the Immigration Act to be a Convention Refugee. The refund provisions set out in paragraphs 6 and 7 are specified by the Bylaws of the Private Career Training Institutions Agency.

  9. Student Evaluation. Program evaluation will take place by a minimum of one written test and one written evaluation as per each Level and Segment of the YTC Program.

  10. Certification. Upon successful completion of the Program, graduates will be awarded one of the following designations:
    1. Yoga Teacher 200hr - Level 1 Certificate for students who facilitate yoga classes of all-levels
    2. Advanced Yoga Teacher 300hr - Level 2 ~ Segment 1 - Yoga Teacher Certificate for students who identity potentially challenging individual needs. It also enables the teacher to facilitate advanced and intermediate yoga classes.
    3. Advanced Yoga Teacher 500hr - Level 1 & 2 ~ Segment 2 - YTC (Yoga Teacher Certification) for students who have completed the diploma requirements for the 500 hr program which meets Prana Yoga Teacher College and Yoga Alliance International standards.

    Prana will issue and mail certificates within one month of the completion of Program requirements.

  11. Certification Withheld. Please note that Prana reserves the right to withhold certification from any student who has completed all tangible program requirements but is, in the opinion of Prana, not competent or qualified to teach yoga, is unable to adequately represent Prana's teaching principles and ethics; or is unable to deal effectively and or appropriately with yoga students.

  12. Student Assessment Appeal Policy. A written appeal must be handed into the Director of Program. The appeal will be then be evaluated by the board of Directors of YTC. The criteria for receiving the diploma are: - acceptable attendance during the program and satisfactory completion of all assignments of the program. It will then be the board of directors final and binding decision whether or not a student met these criteria.

  13. Personal Information. In accordance with Part 4(10)(1)(a) of the Personal Information Protection Act, we hereby notify you that your name and personal identification information, the name of your program of study, and the amount of the tuition paid will be forwarded to the Private Career Training Institutions Agency for the purpose of administering the Student Training Completion Fund. This information is collected by the PCTIA under section 26 of the Freedom of Information and Protection of Privacy Act. For more information about the collection, use and disclosure of your personal information, visit the Agency's website at www.pctia.bc.ca.

  14. Photo Release. You hereby irrevocably grant to Prana (for all media throughout the world (including print, home video, CD-ROM, DVD, internet and any other electronic medium presently in existence or invented in the future) the right to use, including, without limitation, the right to exhibit, display, broadcast, distribute and create derivative works of and incorporate (alone or together with other materials), in whole or in part, photographs and video footage taken of you as a result of your participation in approved Prana activities (the "Property"). You hereby relinquish any right that you may have to examine or approve any completed products, advertising or printed matter that may use the Property. This agreement shall not obligate Prana to use the Property or to use any of the rights granted hereunder. Prana shall have the right to assign its rights hereunder, without your consent, in whole or in part, to any person or legal entity.

  15. Waiver of Right to Sue. You waive any and all claims you may now and in the future have against, and release and forever discharge from all liability, and agree not to sue, Prana, or any of either of its owners, operators, instructors, volunteers or other representatives (all together, the "Prana Group") for any personal injury, death, property damage or loss sustained by the applicant as a result of the applicant's participation in the Teacher Training Program and in connection with the Property due to any cause whatsoever, including and without limitation, active or passive negligence, imprudence, lack of skill, error or judgment, breach of contract, or breach of statutory duty of care on the part of any of the Prana Group. Without limiting the foregoing, you hereby agree that you will not bring or consent to others bringing claims or actions against the Prana Group, or any member thereof, on the grounds that anything contained in the Property or the use thereof is defamatory, reflects adversely on you, violates any other right whatsoever, including, without limitation, rights of privacy and publicity.

  16. Indemnity. You agree to save harmless and indemnify the Prana Group from and against any and all liability for any personal injury, death, property damage or loss to any third party, resulting from your participation in the Teacher Training Program.

  17. Dispute Resolution Policy and Procedure for internal student conflict. Individuals should always try to resolve issues informally. If a more formal approach becomes necessary, Prana provides a fair and reasonable mechanism for resolution.
    1. Step 1. First try to resolve the issue directly with the other party. If this doesn't work proceed to Step 2.
    2. Step 2. Put your complaint in writing to the designated Student Council for handling disputes. He or she will request submissions from all involved parties, including witnesses; conduct an investigation and set up a meeting within 48 hours. The designated Student Council will provide a written decision to all parties within 48 hours of meeting. If this doesn't work proceed to Step 3.
    3. Step 3. Repeat step two with a higher authority within Prana, if possible. If no resolution is forthcoming proceed to Step 4.
    4. Step 4. The parties appoint an outside mediator/arbitrator within 48 hours. The requesting party will bear the cost of mediation/arbitration.

  18. Dispute Resolution Policy and Procedure for students involving Prana Yoga Teacher College Individuals should always try to resolve issues informally. If a more formal approach becomes necessary, Prana provides a fair and reasonable mechanism for resolution.

*Students who choose Payment Option Two will graduate from the program and receive their diploma or certificate when program fees have been paid to the college in full.
